| USERRA / Military Employment Rights Under USERRA, The Uniformed Services Employment and Reemployment Rights Act of 1994, Veterans returning from active duty to their civilian employment are entitled, under most circumstances, to the position that they would have held had they not been on military leave. This means that if a veteran can establish that he or she likely would have been promoted if he or she had not taken military leave, then he or she is entitled to that position, or a comparable position, upon return from active duty.
