DOG BITE CASE FOR MINOR CHlLD SETTLES FOR $225,000.00

John A. Walkowski represented the mother of a minor child and
successfully negotiated a settlement for injuries sustained as a result of the dog bite. On March 20, 2009, the minor child was an invited friend with children of the defendants residing in Hampstead, New Hampshire. At approximately 9:00 p.m., the minor child and the other children were in the attic and playroom on air mattresses. The defendants owned a large golden retriever and, while the children
were playing on the air mattresses, the dog jumped onto the air mattress and bit the minor child in the face.

An ambulance and EMT's were called to the scene and, upon their arrival, found the minor child on the livingroom sofa with the obvious dog bite on the left cheek and upper lip. The minor child was transported to Lowell General Hospital in the first instance, suffering from multiple lacerations to the face, including a deep laceration on the upper left cheek and left side of the upper lip. The emergency room physician deemed it necessary to transfer the minor child to
Children's Hospital in Boston. The lacerations were anaesthetized and the wounds repaired using monocryl deep sutures and plain gut and fast absorbing gut on the superficial wounds. Subsequent to discharge. the minor followed up with a plastic surgeon at Children's Hospital. In addition, the minor was evaluated by a local plastic surgeon who opined the scars are noticeable because they have spread and there is residual redness 13 months after the accident. Multiple scarring continues to exist and even the most inferior scar has more redness to it and is more obvious because of its spread. The plastic surgeon further opined the scars on both sides of the face are permanent and disfiguring and are easily seen within sitting distance.

The medical bills incurred for the minor child totaled $9,077.11. The plastic surgeon opined any future procedures will be approximately $7,850.00. The negotiated settlement in the amount of $225,000.00 was approved by the Court. The net proceeds were invested for the benefit of the minor child in an irrevocable trust.
